Divorce Mediation
No one needs to tell two people who are contemplating or going through a divorce that the process can be extremely difficult and unsettling. We all know that. The more enlightened question is whether there is a better way of achieving a fair and reasonable divorce settlement than the traditional "my lawyer versus your lawyer" approach. Fortunately there is. In recent years, many forward thinking couples have turned to mediation as a much better and more cost effective approach to achieving a divorce settlement. In divorce mediation, the couples themselves meet with a mediator (neutral third party) who helps and guides them through the issues of custody, parenting time, child support, spousal support and equitable distribution, as well as to develop an appropriate Parenting Plan. Attorneys can certainly be used in the mediation process, though their role is typically that of an advisor to their client and not that of negotiator. Rather, the parties themselves retain control of the negotiation process thereby containing costs and fashioning a result that addresses the interests and needs of all family members. And with mediation, much of the acrimony and stress that normally accompanies the litigation process can be eliminated which leaves the parties in a better position in terms of adjusting to the reorganization of the family unit.
